Travel Terms & Conditions

1.INTRODUCTION

These Travel Terms & Conditions (“Terms”) apply to all travel planning, reservation, booking, consultation, and related services arranged by Baraldi Voyages (“Baraldi Voyages,” “we,” “us,” or “our”) for a traveler or client (“Client,” “you,” or “your”).

By requesting travel services, authorizing a reservation, making a payment, accepting a proposal or quote, or otherwise proceeding with a booking arranged by Baraldi Voyages, you acknowledge that you have read, understood, and agreed to these Terms.

These Terms apply to travel arrangements including, but not limited to:

• Cruises
• Hotels
• Resorts
• All-inclusive vacations
• Vacation packages
• Tours and escorted vacations
• Air transportation
• Rail transportation
• Rental cars and other ground transportation
• Excursions and activities
• Entertainment and event tickets
• Travel insurance and travel protection
• Other travel-related services arranged through third-party travel suppliers

2.ROLE OF BARALDI VOYAGES

Baraldi Voyages is an independent travel advisor affiliated with Atlas Coast Travel Group.

Baraldi Voyages assists Clients in researching, recommending, arranging, and coordinating travel services offered by independent third-party travel suppliers.

Depending on the travel purchased, these suppliers may include cruise lines, airlines, hotels, resorts, tour operators, transportation companies, excursion providers, entertainment companies, travel insurance providers, and other travel-service providers.

The travel supplier—not Baraldi Voyages—is generally responsible for actually providing the purchased travel service.

Examples include:

• A cruise line providing a cruise
• An airline providing air transportation
• A hotel or resort providing accommodations
• A tour operator providing a tour or vacation package
• A transportation company providing transportation
• An excursion provider providing an activity
• A travel insurance company providing insurance coverage

Baraldi Voyages does not own, operate, control, or provide these third-party travel services unless specifically stated otherwise.

3.TRAVEL SUPPLIER TERMS AND CONDITIONS

Each travel supplier has its own terms, conditions, cancellation policies, payment schedules, rules, restrictions, and requirements.

By booking travel, you agree to comply with the applicable supplier’s terms and conditions in addition to these Terms.

Where a supplier’s terms conflict with these Terms regarding the supplier’s specific travel service, the supplier’s terms and conditions will generally govern that service.

Clients are responsible for reviewing the supplier’s applicable terms and conditions before completing a reservation.

4.TRAVEL QUOTES AND PRICING

Travel quotes and proposals provided by Baraldi Voyages are based on information and availability available at the time the quote is prepared.

Prices, availability, promotions, taxes, fees, fuel surcharges, port charges, resort fees, baggage fees, gratuities, and other costs may change before a reservation is confirmed and may sometimes change after confirmation pursuant to the supplier’s policies.

A quoted price is not guaranteed until the applicable supplier has confirmed the reservation and the required payment has been processed.

Baraldi Voyages is not responsible for price increases imposed by travel suppliers.

Promotional offers, discounts, upgrades, credits, and other incentives are subject to the applicable supplier’s terms, availability, eligibility requirements, and expiration dates.

5.RESERVATIONS AND CONFIRMATIONS

A reservation is not considered confirmed until the applicable travel supplier has accepted the reservation and confirmation has been provided.

Clients are responsible for carefully reviewing all confirmations and travel documents provided by Baraldi Voyages or the applicable supplier.

Please review:

• Traveler names
• Dates of birth
• Travel dates
• Destinations
• Cabin or room category
• Flight information
• Departure and arrival times
• Transportation arrangements
• Excursions
• Pricing
• Payment deadlines
• Cancellation terms
• Special requests
• Travel insurance
• Passport and identification information

Any error should be reported to Baraldi Voyages immediately.

6.CLIENT INFORMATION

Clients are responsible for providing complete and accurate information required to make their travel arrangements.

This may include:

• Full legal names
• Dates of birth
• Contact information
• Passport information
• Loyalty-program numbers
• Emergency contact information
• Special requests
• Accessibility requirements
• Dietary requirements
• Other information required by the travel supplier

Baraldi Voyages is not responsible for costs, penalties, denied boarding, denied entry, missed travel, or other consequences resulting from inaccurate, incomplete, or outdated information supplied by the Client.

7.PAYMENTS

All deposits, installment payments, and final payments are subject to the payment schedule established by the applicable travel supplier.

Clients are responsible for making all required payments by the applicable deadlines.

Failure to make a required payment on time may result in cancellation of the reservation, loss of deposit, loss of promotional pricing, loss of availability, or other penalties imposed by the supplier.

Baraldi Voyages is not responsible for supplier penalties resulting from a Client’s failure to make timely payments.

Payment methods and payment procedures may vary depending upon the travel supplier and booking arrangements.

8.CANCELLATIONS AND CHANGES

Cancellation and change policies are established by the applicable travel supplier.

These policies may include:

• Non-refundable deposits
• Cancellation penalties
• Change fees
• Fare differences
• Lost promotional benefits
• Non-refundable hotel or resort payments
• Airline penalties
• Cruise cancellation penalties
• Tour cancellation penalties
• Supplier administrative fees

Clients are responsible for all applicable supplier penalties and charges resulting from cancellation or changes.

Baraldi Voyages will make reasonable efforts to assist Clients with cancellations and changes when requested, but cannot guarantee that a supplier will approve a requested change, refund, credit, waiver, or exception.

9.TRAVEL DOCUMENTS AND ENTRY REQUIREMENTS

Clients are responsible for obtaining and maintaining all documents required for their travel.

Depending on the itinerary, requirements may include:

• Valid passports
• Visas
• Entry permits
• Transit visas
• Government-issued identification
• Proof of citizenship
• Birth certificates
• Consent documentation for minors
• Vaccination or health documentation when required
• Other documents required by a destination, government, airline, cruise line, hotel, resort, or other supplier

Travel requirements may change.

Baraldi Voyages may provide general information or resources regarding travel-document requirements, but Clients are responsible for independently verifying that they possess the correct and valid documents for their specific itinerary.

A Client’s failure to obtain required documentation may result in denied boarding, denied entry, missed travel, cancellation, or financial loss.

10.TRAVEL INSURANCE AND TRAVEL PROTECTION

Baraldi Voyages strongly recommends that Clients consider purchasing appropriate travel insurance or travel protection.

Travel insurance may provide protection for certain circumstances such as trip cancellation, interruption, delays, baggage problems, medical emergencies, or other covered events, depending on the policy purchased.

Travel insurance coverage varies by policy.

Clients are responsible for reviewing the policy, exclusions, limitations, eligibility requirements, coverage amounts, deadlines, and claim procedures before purchasing.

Baraldi Voyages does not determine whether a particular claim is covered.

Insurance claims must be submitted to the applicable insurance provider according to that provider’s procedures.

Travel insurance is not a substitute for appropriate medical insurance or emergency medical planning.

11.TRAVEL SUPPLIER RESPONSIBILITY

Travel suppliers are responsible for the services they provide.

Baraldi Voyages is not responsible for the acts, omissions, errors, negligence, insolvency, bankruptcy, schedule changes, cancellations, delays, overbooking, equipment failures, strikes, labor disputes, weather events, government actions, or other conduct or circumstances involving a third-party supplier.

This includes, without limitation:

• Cruise lines
• Airlines
• Hotels
• Resorts
• Tour operators
• Transportation providers
• Excursion providers
• Restaurants
• Entertainment providers
• Event-ticket providers
• Travel insurance companies
• Other third-party suppliers

Where appropriate, Baraldi Voyages will assist Clients in communicating with the applicable supplier regarding issues that arise.

12.ITINERARY CHANGES AND TRAVEL DISRUPTIONS

Travel suppliers may change itineraries, schedules, ports, flights, accommodations, activities, equipment, transportation, or other travel arrangements.

For cruises, this may include changes to ports of call, sailing times, ship schedules, excursions, or itineraries.

For air travel, this may include flight delays, cancellations, schedule changes, equipment changes, missed connections, or rebooking.

For hotels, resorts, and tours, this may include changes to accommodations, activities, facilities, transportation, or schedules.

Baraldi Voyages will make reasonable efforts to assist Clients when such changes occur but cannot control the decisions of third-party suppliers.

13.FORCE MAJEURE

Baraldi Voyages shall not be responsible for losses, delays, cancellations, expenses, or disruptions resulting from circumstances beyond our reasonable control.

Such circumstances may include, but are not limited to:

• Severe weather
• Hurricanes
• Floods
• Earthquakes
• Fires
• Natural disasters
• Pandemics or epidemics
• Government actions
• Travel restrictions
• War
• Civil unrest
• Terrorism
• Strikes
• Labor disputes
• Transportation disruptions
• Mechanical failures
• Supplier insolvency or bankruptcy
• Public health emergencies
• Other circumstances beyond reasonable control

Supplier-specific policies will determine what refunds, credits, rebooking options, or other remedies may be available.

14.SPECIAL REQUESTS

Baraldi Voyages may communicate Client requests to the applicable supplier.

Examples include:

• Connecting rooms
• Room locations
• Dietary requests
• Accessibility requests
• Special occasions
• Bedding preferences
• Cabin locations
• Seating requests
• Airport assistance
• Other special arrangements

Special requests are not guaranteed unless specifically confirmed by the supplier.

A request being communicated to a supplier does not constitute confirmation.

15.HEALTH, MEDICAL, AND ACCESSIBILITY CONSIDERATIONS

Clients are responsible for determining whether they are physically and medically able to participate in their chosen travel arrangements and activities.

Certain travel experiences may involve physical activity, stairs, walking, water activities, excursions, remote destinations, or other conditions that may not be suitable for every traveler.

Clients should consult their healthcare professional regarding medical or health concerns before traveling when appropriate.

Clients should inform Baraldi Voyages of relevant accessibility or special-assistance needs so that those requests can be communicated to the appropriate supplier.

Supplier policies and limitations may apply.

16.EXCURSIONS AND ACTIVITIES

Excursions, tours, activities, and experiences may be operated by independent third-party providers.

Participation may involve inherent risks.

Clients are responsible for reviewing the applicable supplier’s requirements, restrictions, age limits, physical requirements, cancellation policies, and safety instructions.

Baraldi Voyages does not control the operation of third-party excursions or activities.

17.AIR TRAVEL

Air transportation is provided by the applicable airline.

Airlines establish their own fares, schedules, baggage policies, seating policies, cancellation policies, change fees, boarding requirements, and other conditions of carriage.

Clients are responsible for complying with airline requirements and arriving at the airport with sufficient time for check-in, security, boarding, and other required procedures.

Baraldi Voyages is not responsible for missed flights resulting from a Client’s failure to arrive on time.

18.CRUISE TRAVEL

Cruise reservations are subject to the applicable cruise line’s passenger ticket contract and terms and conditions.

Cruise lines may impose requirements regarding passports, identification, medical documentation, travel insurance, health screening, boarding times, age restrictions, minors, alcohol, conduct, luggage, excursions, and other matters.

Cruise itineraries, ports, departure times, and activities may change.

Clients should carefully review the applicable cruise line’s documents and requirements before departure.

19.HOTEL, RESORT, AND ALL-INCLUSIVE TRAVEL

Hotel, resort, and all-inclusive reservations are subject to the property’s and/or applicable supplier’s terms and conditions.

Additional charges may apply, including:

• Resort fees
• Parking fees
• Taxes
• Service charges
• Deposits
• Incidental holds
• Destination fees
• Energy or facility fees
• Other property-imposed charges

Clients are responsible for charges imposed directly by the property or supplier.

20.PASSPORTS, VISAS, AND INTERNATIONAL TRAVEL

International travel may require passports, visas, transit documentation, proof of onward travel, or other documentation.

Requirements vary by nationality, destination, itinerary, and travel circumstances.

Clients are responsible for verifying requirements applicable to their individual circumstances with the appropriate government authorities and travel suppliers.

Baraldi Voyages does not guarantee admission into any country or territory.

21.TRAVEL ADVISOR FEES

Baraldi Voyages may, where applicable, charge professional service, planning, consultation, cancellation, change, research, or other disclosed fees.

Any applicable fee will be disclosed to the Client before the fee is charged.

Supplier commissions or other compensation may also be received by Baraldi Voyages when applicable.

The amount of commission received from a supplier does not determine the recommendation of a particular travel product.

22.COMMISSIONS AND SUPPLIER COMPENSATION

Baraldi Voyages may receive commissions or other compensation from travel suppliers for eligible bookings.

Compensation may vary by supplier, product, booking type, promotional program, or other factors.

Baraldi Voyages may recommend travel options based on suitability, availability, Client preferences, value, experience, and other relevant considerations.

23.LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Baraldi Voyages shall not be responsible for losses, damages, expenses, injuries, delays, cancellations, missed connections, lost luggage, denied boarding, denied entry, schedule changes, supplier failures, or other consequences arising from the acts or omissions of third-party travel suppliers or circumstances beyond Baraldi Voyages’ reasonable control.

Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded or limited under applicable law.

Baraldi Voyages’ responsibilities are limited to the travel-advisory and booking services that we actually provide.

Clients agree that any claim against Baraldi Voyages arising from our services shall be subject to applicable law and the limitations permitted by law.

24.CLIENT RESPONSIBILITY

Clients agree to:

1. Provide accurate information.
2. Review all travel documents and confirmations.
3. Make payments by required deadlines.
4. Review supplier terms and cancellation policies.
5. Obtain required travel documents.
6. Verify applicable entry and travel requirements.
7. Purchase appropriate travel insurance when desired.
8. Follow supplier rules and policies.
9. Arrive at airports, ports, hotels, and other departure points on time.
10. Immediately notify Baraldi Voyages of errors or problems identified in travel documents.

25.COMMUNICATION

Clients should promptly review communications from Baraldi Voyages and travel suppliers.

Clients are responsible for maintaining current contact information and checking email, telephone messages, and other communications used for their reservation.

Baraldi Voyages is not responsible for consequences resulting from a Client’s failure to receive or review communications because of incorrect contact information, email filtering, missed messages, or failure to monitor communications.

26.PRIVACY AND CLIENT INFORMATION

Baraldi Voyages may collect and use information necessary to research, arrange, administer, and coordinate travel services.

Information may be shared with applicable travel suppliers and service providers when necessary to fulfill a Client’s travel arrangements.

Baraldi Voyages will handle Client information in accordance with applicable privacy requirements and its Privacy Policy, when applicable.

Clients should not send credit-card numbers, passwords, or other highly sensitive information through unsecured email or ordinary text messages unless specifically instructed to do so through an approved secure payment process.

27.THIRD-PARTY WEBSITES AND SERVICES

Baraldi Voyages may provide links or references to third-party websites, including cruise lines, airlines, hotels, resorts, tour operators, travel insurance companies, government agencies, and other providers.

Baraldi Voyages does not control the content, availability, privacy practices, security, or policies of third-party websites.

Clients are responsible for reviewing the terms and privacy policies of third-party websites they access.

28.PHOTOGRAPHS, DESCRIPTIONS, AND INFORMATION

Travel descriptions, photographs, maps, ratings, amenities, room descriptions, ship descriptions, destination information, and other promotional material may originate from travel suppliers or other third parties.

While Baraldi Voyages makes reasonable efforts to provide useful and accurate information, supplier offerings and descriptions may change.

The applicable supplier’s current information and confirmed reservation documents control the actual travel arrangements.

29.DISPUTES AND GOVERNING LAW

These Terms shall be interpreted in accordance with applicable law.

Nothing in these Terms is intended to deprive a Client of any rights or remedies that cannot legally be waived.

Before initiating formal legal proceedings, the Client and Baraldi Voyages agree to make a good-faith effort to resolve any dispute through direct communication.

If a dispute cannot be resolved informally, any legal proceedings shall be handled in a court having proper jurisdiction under applicable law.

30.GOVERNING LAW AND VENUE

These Terms and Conditions and any agreement between the Client and Baraldi Voyages shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to conflict-of-law principles.

To the fullest extent permitted by applicable law, any dispute, claim, or legal action arising out of or relating to the services provided by Baraldi Voyages, these Terms and Conditions, or the Client’s relationship with Baraldi Voyages shall be brought exclusively in the state or federal courts located in or serving Virginia Beach, Virginia, and the parties consent to the jurisdiction and venue of such courts.

Nothing in this provision shall prevent Baraldi Voyages from asserting any rights, remedies, defenses, or protections available under applicable federal or state law, or from complying with any mandatory jurisdiction, venue, consumer-protection, or other legal requirements that cannot lawfully be waived or modified by agreement.

31.SEVERABILITY

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, the remaining provisions shall remain in effect to the fullest extent permitted by law.

32.CHANGES TO THESE TERMS

Baraldi Voyages may update these Terms from time to time.

The Terms applicable to a particular reservation will generally be the Terms in effect when the Client accepts the Terms or makes the applicable booking, unless otherwise required by law or agreed in writing.

The most current version will be made available on the Baraldi Voyages website.

33.ENTIRE AGREEMENT

These Terms, together with applicable supplier terms and conditions and any written agreements or disclosures specifically provided to the Client, constitute the agreement governing the travel-advisory services provided by Baraldi Voyages.

If a written agreement signed by Baraldi Voyages and the Client specifically states that it supersedes a provision of these Terms, that written agreement will control that provision.

34.CLIENT ACKNOWLEDGMENT

By proceeding with a reservation or travel arrangement through Baraldi Voyages, the Client acknowledges that:

• They have read and understood these Travel Terms & Conditions.
• They understand that Baraldi Voyages acts as an independent travel advisor and intermediary in arranging travel services.
• They understand that the actual travel services are generally provided by independent third-party suppliers.
• They understand that supplier terms and conditions, cancellation policies, payment deadlines, and restrictions apply.
• They understand that travel involves inherent risks and that itineraries and travel arrangements may change.
• They understand the importance of obtaining appropriate travel insurance.
• They agree to provide accurate information and review all travel documents and confirmations.
• They agree to these Terms.
